Before placing your order, please read carefully these Terms and Conditions. You accept and agree to be bound by these Terms and Conditions when you “accept” online purchases.

Delivery to the United Kingdom (incl. Northern Ireland)

Delivery on orders over £300 – Free of Charge (we use Royal Mail’s Tracked 24 ‘signed for’ Service). For full details please visit Royal Mail Website

Standard Delivery 48 hours from despatch – £4.95

For standard delivery we use Royal Mail UK Tracked 48 ‘signed for’ Service. A signature confirming receipt is required for delivery. If there is no one available at the delivery address to accept your order the Royal Mail will leave a card asking you to arrange collection from your nearest depot. Next day delivery – £8.95

For next day delivery, orders placed before 3.00pm will be shipped that day (Monday to Friday). We operate a next day delivery service using Royal Mail’s “Special delivery Guaranteed by 1pm“. Delivery is guaranteed by 1pm the following day (Monday to Friday) for most destinations. For exceptions and full details please visit Royal Mail website.

Tracking Number

For all Royal Mail Services, we will email notification of your tracking number, so you can follow your parcel’s progress.

A signature confirming receipt is required for delivery. If there is no one available at the delivery address to accept your order the Royal Mail will leave a card asking you to arrange collection from your nearest depot.

International Delivery (including Europe)

Currently unavailable.

All prices displayed are in pounds sterling and inclusive of VAT at the current rate.

Local import taxes may be applied to deliveries outside the UK, which will be your responsibility. The custom office may hold your goods if the local import taxes are not paid.

Stock Availability

All items on the Jane Young “Online shop” are in stock and available for UK Next Day Delivery. If for any reason stock is not available to process your order, we will email to inform you. If you paid using a credit or debit card, you will not be charged for unavailable stock.

Colour

We try to represent our products as accurately as possible through our photography. However, colours may vary depending on customer’s monitor settings and resolution over which we have no control. Therefore we are unable to guarantee exact likeness of colour as it appears on our website.

Sizes

Sizes can vary between manufacturers which can cause some discrepancies with your known size. Some garments come in several different fits which may alter the size you require, depending on desired fit. Placing an order

When you order items on-line you will need to register with us by setting up an account or purchasing goods as a “Guest”. You are responsible for maintaining the confidentiality of your account username and password and for preventing unauthorised access to your account. You agree to accept responsibility for all activities that occur on your account. Please take all necessary steps to ensure that the username and password is kept confidential and secure. Please inform us immediately if you have any reason to believe that your username and/or password has become known to anyone else, or are being or are likely to be used in an unauthorised way. Please ensure the details which you provide on registration are correct and complete and inform us promptly of any changes to those details (e.g. change of email or postal address). We reserve the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order it will be without charge to you.

VAT and duties

Please note that the value of goods displayed and ordered is inclusive of VAT where applicable and we cannot refund any VAT charges. We accept payment online in Pounds Sterling (£GBP) only. The price of the items will be in line with the price displayed on the website when you placed your order. Although we try to ensure that all prices on the Website are accurate, errors may sometimes occur. If we discover an error in the price of items you have ordered we will contact you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we may treat your order in respect of the incorrectly priced item as cancelled.

Contract & Acceptance

When you place an order to purchase items using the Website this is an offer by you to us to purchase those items. We only accept your order when we have confirmed availability and have processed the payment on your credit card successfully. The contract between us is formed at the point when we acknowledge that the order has been dispatched “Jane Young Fashions: Shipment#”. If an item within your order is not available we will contact you. We acknowledge that an order has been dispatched by sending you an email summarising the details of your shipment (“Jane Young Fashions: Shipment #”). those items which have yet to be processed do not form part of that contract.

Payment

You may pay for your order by supplying your credit or debit card details. We accept the following card types: Visa Debit, Visa Credit, Delta, Mastercard, Maestro, Electron and JCB. In the case of on-line orders you supply these details through Stripe’s secure system. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. Acceptance of your order occurs in the case of on-line orders when we send you the Online Jane Young:New order. You are responsible for ensuring the email address and other contact details you provide to us are correct. We will not be responsible if you do not receive the New Order or Shipment Note email or other confirmation from us where the details you have supplied are incorrect or in the event of communication system failures outside our control.

Please do not send us payment information using email as we can not guarantee security of data.

Risk & Title

Risk in the items will pass at the time the items are delivered. Ownership of items delivered will only pass when we receive payment in full of all sums due in respect of the items (including packing and delivery costs). If we do not receive payment in full we may, without prior notice, claim from you any items that have been delivered.

Gift Cheque

Once purchased, the Jane Young Gift Cheque can be used in-store and online. If you wish to redeem a Gift Cheque for an online purchase please contact the Jane Young sales team to complete the transaction. A credit note will be given for part-payments and any remaining balance may be applied to future purchases. Use of the Jane Young Gift Cheques constitutes acceptance of these terms and conditions.

Privacy

When you place orders, we collect certain personal and transactional information (e.g. name, address, telephone number, email address, credit/debit card details). For details on how we use this information, please read our Privacy Policy. To fulfil our obligations to you under these Terms and Conditions we communicate with you by e-mail or telephone and by posting notices on the Website. You agree to receive communications from us electronically in this way and that electronic communications will satisfy any legal requirement for communications to be in writing.

Losses

We will be responsible for any losses you suffer as a direct result of us breaching these Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract between us for the sale of items was formed (see “The Contract and Acceptance” section above). We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions or the actions of our appointed sub-contractors or agents, whether it be consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.

Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these Terms and Conditions excludes or limits our liability to you for personal injury or death caused by our negligence. We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

Changes to website and conditions

We reserve the right at any time to make changes to the Website, Conditions and Privacy Policy and such other policies as we may notify you of from time to time. You will be subject to the policies and terms and conditions in force at the time you order items. Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, they will be deemed severable and will not affect the validity or enforceability of the remaining terms and conditions.

Privacy & Security

Your privacy is importance to us. We promise never to release your personal details to any outside company for mailing or marketing purposes. When you make a purchase from our website, we collect certain personal information from you (for example: your name, email address, payment address and details). All such information is held on secure servers. Jane Young complies fully with all applicable Data Protection and consumer legislation, and will treat all your personal information as fully confidential. In order to serve you most efficiently, reputable third-party banking (including PayPal) and distribution institutions handle our credit card transactions and order fulfillment. They receive the information needed to verify and authorise your payment card and to process your order. All such organisations are under strict obligation to keep your personal information private.
